In 2010, Erie County Legislator Tim Kennedy was elected to the New York State Senate in the 58th New York Senate District. He defeated a Democratic incumbent in the primary of that year and a Republican Assemblyman in a close General Election, beginning a 13 year career in Albany. He survived a Primary challenge by 139 votes in 2012 and would go on to be one of the leading voices for both Western New York and for Democrats in the Senate conference.

On November 14, 2023, Kennedy announced that he would run for the soon-to-be vacated congressional seat held at the time by Brian Higgins. He won the election on May 6, 2024, defeating Republican nominee Gary Dickson, and raising over $2.6 million towards his victory.
